Terms and Conditions of Service

Welcome to Polygon Infotech. These Terms and Conditions ("Terms") govern your access to and use of our website (https://polygoninfotech.in), enterprise software platforms (including Polygon Pathshala and JewelChain ERP), web applications, custom software solutions, and related technical services provided by Polygon Infotech. By accessing our services, licensing our software, or entering into a project contract with us, you agree to be bound by these Terms.

1. Scope of Services

Polygon Infotech provides custom software development, enterprise ERP engineering, website design, mobile application development, database architecture, and technical support. Specific deliverables, project milestones, timelines, and payment terms for client projects are defined in individual technical proposals, Service Level Agreements (SLAs), or project contracts.

2. Intellectual Property Rights

  • Proprietary Software & Frameworks: Polygon Infotech retains all rights, titles, and intellectual property ownership over its underlying core frameworks, reusable code modules, proprietary panel systems (including NextPI), and flagship platform templates (such as Polygon Pathshala and JewelChain ERP), unless explicitly transferred in writing under a custom development contract.
  • Client Assets & Data: All proprietary business data, logos, trademarks, content, and specific database entries provided by the client remain the sole property of the client.
  • Custom Work Product: Upon full and final payment of all agreed project fees, clients are granted a non-exclusive (or exclusive, as defined by individual contract) license to use the developed custom software application for their business operations.

3. User Responsibilities & Acceptable Use

Clients and authorized end-users agree to use Polygon Infotech’s websites and software applications solely for lawful operational purposes. You agree not to:

  • Reverse-engineer, decompile, disassemble, or attempt to extract the source code of our proprietary software frameworks.
  • Attempt unauthorized access to our servers, databases, or administrative portals.
  • Use our hosting infrastructure or software platforms to store or transmit malicious code, viruses, or illegal content.
  • Bypass or compromise multi-tier user role security mechanisms, authentication systems, or licensing keys.

4. Payment Terms & Billing

Project fees, subscription payments, and maintenance costs are due according to the schedule set forth in your invoice or project contract. Polygon Infotech reserves the right to suspend software hosting, module updates, or technical support services in the event of overdue or unpaid invoices.

5. Service Availability, Maintenance & Support

While we strive to maintain high system availability and security across hosted platforms, Polygon Infotech schedules periodic server maintenance, database optimizations, and software updates. We provide technical support during standard business hours in accordance with your support package or SLA.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Polygon Infotech, its owner, and employees shall not be liable for any indirect, incidental, consequential, or operational losses arising out of software downtime, third-party internet network failures, improper user operation, or unauthorized access beyond our reasonable technical control.

7. Termination of Service

Polygon Infotech reserves the right to terminate or suspend access to its services or licensed software platforms immediately if a user or client breaches these Terms, fails to comply with licensing agreements, or engages in activities that threaten network security or operational integrity.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any legal disputes or claims arising out of or in connection with these Terms or our services shall be subject to the exclusive jurisdiction of the courts located in Raipur, Chhattisgarh (CG), India.
